A message to employers who aren’t in a current OFCCP audit

If your company was one of the 375 government contractors or subcontractors who recently received a Scheduling Letter from the Office of Federal Contractor Compliance Programs (OFCCP), you’re probably not reading this post. You’re too busy scrambling to pull together responses to the 22 items in the Scheduling Letter and Itemized Listing and making sure your affirmative action plans are up to date.

But if you didn’t receive a scheduling order … read on.

Now is a perfect time to check up on your company’s compliance with the various requirements imposed on federal contractors and subcontractors, so that you’re ready when you do receive notice of an OFCCP audit. Every contractor knows that it must maintain affirmative action plans for minorities and women and for the disabled and protected veterans and that it must file EEO-1 and VETS-4212 forms once a year. But are you confident that you’re complying with all the other OFCCP obligations on federal contractors? Here is a quick checklist you can use to make sure your company is in compliance.

What contractors need to know about new sex discrimination rules

OFCCPOn June 15, the Office of Federal Contract Compliance Programs (OFCCP)  published a final rule detailing the obligations of federal contractors to ensure nondiscrimination on the basis of sex, and to take affirmative action to treat all applicants and employees equally without regard to sex.

OFCCP is an agency within the Labor Department that enforces a number of employment-related laws applicable to federal contractors, including Executive Order 11246, which bars discrimination on the basis of sex and race. OFCCP originally published its Sex Discrimination Guidelines in 1970, but had not previously revised them.  This new rule represents the agency’s interpretation of Executive Order 11246 as it relates to discrimination on the basis of sex, sexual orientation, or gender identity in light of 45 years of legal developments.

The new rule takes effect Aug. 15, 2016.

DOL issues final rule revising sex discrimination guidelines for federal contractors

OFCCPOn June 15, the U.S. Department of Labor (DOL) issued a final rule revising the Office of Federal Contract Compliance Programs’ (OFCCP) long-standing sex discrimination regulations.

According to the DOL, the rule “substantially revises the existing sex discrimination guidelines, which have not been substantively updated since 1970, to align them with current law and legal principles and address their application to contemporary workplace practices and issues.”

The final rule is effective August 15, 2016, and applies to employers with federal contracts or subcontracts totaling $10,000 or more over a 12-month period, unless those employers are otherwise exempt. The final rule implements Executive Order 11246, which after amendments issued by President Obama, prohibits sex discrimination, including on the basis of sexual orientation and gender identity.

Moody AFB contractor sued over equal opportunity reporting

The U.S. Department of Labor (DOL) has filed a lawsuit to require Convergys Customer Management Group Inc. to submit documents detailing its affirmative action plans for company facilities in Florida, North Carolina, Georgia and Tennessee.

OFCCPFiled with the department’s Office of Administrative Law Judges, the suit requires Convergys to provide the department’s Office of Federal Contract Compliance Programs (OFCCP) with all documents and information requested, cooperate with scheduled compliance reviews and fully comply with the requirements of all laws enforced by the agency.

If the company fails to comply, the department seeks to cancel the company’s current federal contracts and ban Convergys from future federal contracting.

OFCCP offers Jan. 11 webinar to explain new pay transparency rules

Today (January 11, 2016), the final rule implementing Executive Order 13665 goes into effect. The Executive Order prohibits federal contractors from firing or otherwise disciplining employees or job applicants for discussing their pay or the pay of their co-workers.

The Office of Federal Contract Compliance Programs (OFCCP) is hosting a webinar on January 11, 2016 at 2:00 p.m. EST to “provide an overview of the final rule, address questions received by the agency since the rule’s September publication, and illustrate the practical application of defenses provided in the rule through several hypothetical scenarios.”

You can register to attend the webinar here.

Contractors should add the new non-discrimination language to their manuals and handbooks and either disseminate their updated policies to employees or post them conspicuously in the workplace.  In addition, contractors should post the updated “EEO is the Law Posted,” available here.

Responding to a scheduling letter from the OFCCP: Little things matter

It is the Tuesday after a long holiday weekend, and you are faithfully going through the pile of mail on your desk when you spy an envelope from the United States Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP).

OFCCPaffYou open the envelope and, sure enough, your facility has been selected for a compliance review under Executive Order 11246, the Vietnam Era Veterans’ Readjustment Assistance Act, and Section 503 of the Rehabilitation Act.  Which of the following most accurately describes your response?

  1. Hot dog! I finally get to do something with those affirmative action plans I have been patiently preparing for years!
  2. Story of my life . . . any time I take a long weekend, I always return to bad news.
  3. An OFCCP audit?  Someone turn off the lights so I can curl up and cry in the corner.

Comments invited on proposal to require government contractors to report on employee compensation

On August 8, 2014, the Office of Federal Contract Compliance Programs (OFCCP) of the Department of Labor released a proposed rule to require certain contractors to submit reports on employee compensation.

The rule would apply to employers who file Employer Information Reports (EEO-1 Report), have more than 100 employees, and a contract, subcontract or purchase orders amounting to $50,000 or more.

The rule requires them to submit a new Equal Pay report.  This report would include summary data on employee compensation by sex, race, ethnicity, specified job categories, and other relevant data points such as hours worked and the number of employees.

DOL proposes rule to collect compensation data from federal contractors

On August 6, 2014, the U.S. Department of Labor (DOL) announced a proposed rule that would require most federal contractors and subcontractors annually to submit Equal Pay Reports on employee compensation to the Office of Federal Contract Compliance Programs (OFCCP). The aim of the proposed rule is to collect summary data on how federal contractors and subcontractors pay their employees, with an eye toward identifying potential gender-based and race-based pay disparities. This marks a significant change in compliance requirements for the federal contractor community because until now, federal contractors were required to disclose compensation data only in OFCCP compliance reviews.

The Equal Pay Report rule comes after President Obama issued a presidential memorandum on April 8, 2014, instructing the Secretary of Labor to propose a rule to collect summary compensation data from federal contractors and subcontractors. The proposed rule would require contractors to provide compensation information for their workforce broken down by sex, race, ethnicity and specified job categories. The rule was published in the Federal Register on August 8, 2014, and all comments must be received by November 6, 2014. After consideration of public comments, the DOL is anticipated to issue a final rule in the first half of 2015.

Don’t get burned by this summer’s OFCCP enforcement

While federal contractors may have been looking forward to having a summer break from new affirmative action regulations and related enforcement activities, President Obama and the U.S. Department of Labor’s Office of Federal Contractor Compliance Programs (OFCCP) have had other ideas.

Indeed, President Obama and the OFCCP have turned up the heat on federal contractors this summer by: (1) issuing a slew of new executive orders and other regulations that exponentially increase their compliance obligations, and (2) sending out a second wave of corporate scheduling announcement letters advising of future compliance audits.

Federal contractors’ hiring goal for veterans took effect March 24

Effective March 24, 2014, contractors required by the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA) to develop a written affirmative action program (AAP) must also establish a hiring benchmark for protected veterans each year or adopt the national benchmark provided by the Office of Federal Contract Compliance Programs (OFCCP).  Federal contractors use the VEVRAA Benchmark Database when establishing a hiring benchmark for protected veterans as required by 41 CFR 60-300.45.

Contractors must compare the percentage of employees who are protected veterans in each of their establishments to the hiring benchmark set for that establishment.  Contractors should use the result of this comparison when assessing the effectiveness of their veteran outreach and recruitment efforts.

This VEVRAA Benchmark Database provides additional information regarding the establishment of hiring benchmarks and easy access to the national and State data that may be needed to establish these benchmarks.

OFCCP has now posted the Benchmark Database required by the new regulations implementing the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA).   The database includes the annual national percentage of veterans in the civilian labor force for contractors that choose to use this number as their benchmark. It also includes data on the percentage of veterans in the labor force in each State and the number of veterans who participate in each State’s employment service, for use by those contractors choosing to develop an individualized benchmark.

To help contractors use this database, OFCCP provides detailed user instructions and examples illustrating how a contractor could use the database to set an individualized VEVRAA benchmark.
